The EPS Prohibition: A Rule Most Applicants Don't Know

This is the rule that has caught hundreds of Pensioner visa holders off guard since Resolution 5477 came into force. Colombia's national health insurance system (EPS — Entidades Promotoras de Salud) is Colombia's contributory health system for workers and their economic dependents. Pensioner visa holders are explicitly prohibited from enrolling in EPS.

The logic is clear: the EPS is funded through payroll contributions, and Pensioner visa holders are not workers in Colombia. Attempting to enroll in EPS while holding a Pensioner visa violates the terms of the visa category and can result in the visa being declared inadmissible upon renewal.

What you must have instead is a private medical assistance plan compliant with Resolution 5477 — covering accidents, illness, disability, hospitalization, maternity, repatriation and death — that is valid for the entire duration of your visa. This is not optional, and the plan must remain continuously valid throughout your stay.

With permanent residency, you gain full work authorization and a more stable long-term status.

Tax Implications for Pensioners

Pensioners living in Colombia full-time will almost certainly exceed 183 days per year — triggering Colombian tax residency. This means your pension income from abroad becomes subject to Colombian income tax. Given that Colombia has no double taxation agreement with the United States or most other major pension countries, the combined tax burden from both countries should be a core part of your financial planning before moving.
